Matud ni Impeachment presiding officer Senator Judge Chiz Escudero nga miabot sa 13 ka senador-judge ang mibotar pabor sa motion nga gipagawas ni Senator Erwin Tulfo nga naghangyo og reconsideration sa milabay’ng desisyon sa Korte.

“..To explain the vote, an A I or yes vote grants the appeal and overturns the July 6th ruling of the presiding officer. It means that for purposes of determining the two-thirds concurrence vote required for conviction under Article 11, Section 3.6, the phrase, all members of the Senate, open close quotation, shall refer only to those members who at the time of the vote remain legally and factually capable of participating in the impeachment proceedings, thereby excluding members who are, Number one, detained and or suspended or otherwise legally restrained from exercising the functions of a senator. Number two, persons sought by authorities whose whereabouts are unknown.
Number three, suffering from a physical or medical incapacity. Number four, beyond the coercive processes of the Senate. And number five, others similarly situated.
A no vote or a nay vote denies the appeal and sustains the July 6th ruling of the chair. Accordingly, the number of votes required for conviction shall remain at 16 based on the phrase, all members of the Senate, which is currently 24. Lastly, before proceeding, the chair withdraws that.
If there are no objections, the chair shall now proceed to a vote in accordance with Rule 22 of the Rules on Impeachment. All those in favor of the appeal of Senator Judge Erwin Tulfo, say aye. Those against say nay.
Nay. The ayes have it. The appeal is won.
Given the earlier manifestation of Senator Judge Alan Cayetano, that in behalf of some of our senator judge members that they will not participate, the chair would like to place on record the actual vote as reflected based on the 20 members who responded to the roll call earlier. For the record, Senators Alan Cayetano, Pia Cayetano, Senator Go, Senator Marcos, Senator Villar Camille, and Senator Robin Padilla did not participate in the vote. With the casting of a nay vote by the Presiding Officer, 13 voted in the affirmative in favor of the appeal of Senator Judge Erwin Tulfo.
It is therefore 13 affirmative votes, 1 negative vote, and 6 did not participate..”
